Motorists to give way to buses

Under new legislation motorists will have to give way to buses in built-up areas and in particular speed zones. The new law comes into force on 20 August 2008.

Why has this legislation been implemented?

Buses experience difficulties entering the flow of traffic. The legislative change has been made to ensure motorists assist their re-entry, especially during peak periods.

To which buses must I give way?

Motorists are only required by law to give way to buses displaying give way signs, and travelling in built-up zones with a speed limit of 70km/h or less. The regulation is enforceable in all bus routes to which these conditions apply.

What are the penalties for non-compliance?

Motorists may be fined $100 for failing to give way to a bus. However, non-compliance is not a demerit point earning offence.

What signage will buses carry to remind motorists of the give way provision?

A give way sign will be posted on the rear of public and school buses.

What are the bus driver’s responsibilities?

Bus drivers must give sufficient warning before moving from the side of the road. Buses may only enter the line of traffic when it is safe to do so.

What are my responsibilities?

A driver travelling in the left lane, or the left line of traffic on a length of road in a built-up area with a speed zone of 70 km/h or less, must give way to a bus in front of the driver if:

  • The bus has stopped, or is moving slowly, at the far left side of the road, on a shoulder of the road or in a bus stop bay; and
  • The bus displays a give way to buses sign and the right direction indicator lights of the bus are operating; and
  • The bus is about to enter or proceed in the lane or line of traffic which the driver is driving.
